A Design Objection is an official objection filed by the Design Wing of the Indian Patent Office following the examination of a design registration application. It generally occurs when the design examiner detects legal or technical flaws in your application under the Designs Act, 2000.

How Does the Objection Process Work?
Once your design application is submitted:
1. The Examination Examiner examines the application and draws up an Examination Report.
2. If there are any objections, the report is sent to the applicant/agent through the Patent Office portal.
3. βοΈ The applicant has to submit a written response to the objections, and if necessary, revised documents β within 3 months (extendable by 3 further months).
4. If the reply is deemed satisfactory, the application goes on to registration and publication.
5. Otherwise, the Controller can send a hearing notice for an oral explanation before finally deciding.
